Terms of Service

Throughlined is a trade name of TL Marketing LLC ("Throughlined," "we," "us"). These terms govern your use of the Throughlined recruiting messaging platform (the "Platform") and the website at throughlined.com (the "Site"). By messaging a carrier through the Platform, submitting a form on the Site, or otherwise using either, you agree to these terms. If you do not agree, do not use them.

1. What the Platform is

The Platform is a recruiting communications service that trucking carriers (our "Clients") use to respond to drivers who contact them through Facebook, Instagram, Meta lead ads, SMS, and similar channels. When you message a Client's page, comment on its post, or submit its lead form, the Platform may receive that message on the Client's behalf, reply with information the Client has approved, ask qualifying questions, and connect you with one of the Client's recruiters.

Throughlined is not an employer, a staffing agency, or a recruiter. The Client is the business you are applying to. Any job, offer, pay, route, or requirement described in a conversation is the Client's, and the Client's own application process, policies, and terms govern your employment relationship with it.

2. Who may use the Platform

You must be at least 18 years old and seeking work as a commercial driver, or an employee of a Client using the Platform as part of your job. By using the Platform you confirm that the information you provide is accurate and that you have the right to provide it.

3. Messaging and consent

By providing your mobile number to a Client through the Platform and asking to be contacted, you agree that the Client and Throughlined may send you text messages about your inquiry, including recruiter follow-ups and application links. Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, or reply HELP for help. Carriers are not liable for delayed or undelivered messages.

Some replies are drafted with the help of automated systems under rules the Client has approved. Automated replies never make a final hiring decision. Hiring decisions are made by the Client's people.

4. Your information

Our Privacy Policy explains what we collect, how we use it, and the choices you have, including how to request deletion through our Data Deletion Instructions. The Privacy Policy is part of these terms.

5. Acceptable use

You agree not to use the Platform or the Site to:

• provide false information about your identity, experience, licensing, or eligibility;
• harass, threaten, or abuse recruiters or anyone else;
• send spam, advertising, or messages unrelated to a job inquiry;
• probe, scrape, reverse engineer, interfere with, or attempt to gain unauthorized access to the Platform, the Site, or any Client's systems;
• violate any law or any Client's rules, or the terms of Facebook, Instagram, or your mobile carrier.

We may suspend or end your access to the Platform at any time for conduct that violates these terms or that we reasonably believe is harmful.

6. Meta platforms

The Platform receives and sends messages through Meta's APIs on pages Clients have connected. Your use of Facebook and Instagram is also governed by Meta's own terms and policies. Throughlined is not affiliated with Meta, and Meta is not responsible for the Platform. You can remove the Throughlined app from your Meta account at any time in your Facebook or Instagram settings; the Data Deletion Instructions explain what happens next.

7. Clients

A Client's use of the Platform is governed by a separate written agreement between the Client and TL Marketing LLC. Where these terms and that agreement conflict, the agreement controls for the Client. Clients are responsible for the accuracy of the information they approve for use in conversations, for their own hiring decisions and employment practices, and for their compliance with employment, telephone consumer protection, and privacy laws that apply to them.

8. Intellectual property

The Platform, the Site, and their content, design, and software are owned by TL Marketing LLC or its licensors and are protected by copyright and other laws. You may use the Site and the Platform only as these terms allow. You keep ownership of the content of your own messages; you give us and the Client you contacted a license to use that content to operate the Platform and respond to your inquiry.

9. No warranties

The Platform and the Site are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, non-infringement, and any warranty that the Platform will be uninterrupted, error-free, or that any message will be delivered or answered within any particular time. We make no promise that any Client will contact you, interview you, or hire you.

10. Limitation of liability

To the fullest extent the law allows, TL Marketing LLC and its members, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost wages, lost opportunities, or lost data, arising from your use of the Platform or the Site. Our total liability for any claim relating to the Platform or the Site is limited to one hundred dollars ($100). Some states do not allow these limitations, so they may not apply to you.

11. Indemnity

You agree to defend and hold harmless TL Marketing LLC from claims, losses, and expenses, including reasonable attorneys' fees, arising from your violation of these terms or your misuse of the Platform or the Site.

12. Governing law and disputes

These terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Sarpy County, Nebraska, and you consent to their jurisdiction. Nothing in this section prevents either party from seeking relief in small claims court.

13. Changes

We may update these terms. We will post changes here and update the dates at the top. Material changes will be flagged on this page for at least 30 days. Your continued use after a change means you accept it.
